A Will or Testament is a written document by which a person indicates their wishes of how their property is to be disposed of after their death. In order for a Will to be valid it must comply with the formalities prescribed by law and it must have been made freely and voluntarily. In the Will, the person (Testator / Testatrix) will appoint and Executor to administer the estate and dispose of the property in accordance with the provisions of the Will. If a valid Will has been left at the time of death, we say the deceased passed away “testate”.
If a person dies without a valid Will, then their estate will be administered by the provision of the Intestate Succession Act and we say the deceased passed away “intestate”.
